Terms of Service
These terms govern your use of OctOpus, including our hosted application, developer tools and ChatGPT connection.

1. Your agreement and account
By using OctOpus, you agree to these terms. If you use the service for an organization, you must be authorized to act for it. An applicable written agreement with Octoopus, Inc. takes priority over these terms where they conflict.
You must be at least 13 and meet the minimum age required in your country to use the service. If you are below the age of legal majority, a parent or legal guardian must authorize your use and accept these terms where required. The service is not directed to children under 13.
Provide accurate account information, protect your credentials and use only accounts and workspaces you are authorized to access. Tell us promptly if your account is compromised. Organization administrators may manage seats, permissions and organization content.
2. What the service does
OctOpus helps you inspect datasets, analyze data, generate code and reports, and train or evaluate models. Features depend on your plan, the deployment, available dependencies and the data you supply. Outputs may be incomplete or incorrect; model quality, runtime and particular results are not guaranteed.
Review generated code and validate predictions, metrics and reports before relying on them. You remain responsible for decisions and deployments based on the output. Do not use the service as the sole basis for decisions that materially affect a person's rights, safety or access to essential services.
3. Your data and permissions
You retain the rights you hold in your inputs. You give Octoopus, Inc. permission to store, reproduce, process and transmit those inputs as needed to provide, secure and support the service, including processing by the service providers described in our Privacy Policy. This permission does not transfer ownership of your inputs to us.
You must have the rights and lawful basis necessary to upload and process your data and to send it to any connected service. Do not put passwords, secret keys, payment-card information or unnecessary sensitive personal data into prompts or datasets. Do not submit regulated data unless your agreement and deployment expressly support that use.
As between you and Octoopus, Inc., you may use generated outputs to the extent permitted by law and any applicable third-party rights. Outputs may not be unique or eligible for intellectual-property protection. Third-party code, datasets and models retain their own licenses; you are responsible for complying with them.
4. Acceptable use
Use the service lawfully and within the permissions granted to you. Do not use it to harm others, infringe rights, distribute malware, commit fraud, conduct unauthorized surveillance or gain unauthorized access. Do not bypass ownership checks, credit limits, security controls or cancellation controls, or interfere with other users' work. Do not represent generated results as verified facts without appropriate validation.
5. Plans, usage and billing
Your existing order, subscription or written agreement controls the price, billing period and included allowance. Computational work can consume your allowance, including analysis that does not result in a trained model. Usage already incurred may remain chargeable after cancellation. Applicable refund, withdrawal and other mandatory consumer rights are not limited by these terms; contact support for billing questions.
Keep your own copies of important inputs and results. A credit balance or an accepted job is not a guarantee that a particular model or result will be produced.
6. Using OctOpus in ChatGPT
The ChatGPT connection uses your existing OctOpus account and credits. It does not sell subscriptions, initiate checkout, purchase credits or add a ChatGPT-specific fee. ChatGPT access and availability are separate and subject to OpenAI's terms and workspace controls.
When you connect, review the requested permissions. Requested project information, datasets, analysis results and training status can be sent between OctOpus and ChatGPT. Approve the target, metric, experiment count and compute and runtime limits before starting training. Limits govern the submitted job; a cancellation request may take time to stop active work.
You can revoke a connection on the connection management page. Revocation stops future use of that connection. It does not cancel jobs already accepted, delete stored projects, or remove copies already held by ChatGPT. Cancel jobs and request deletion separately when needed.
7. Third-party services
The service may use external hosting, compute, model, payment or data providers. Their terms may also apply to your use of their services or materials. We do not control their availability or guarantee their outputs. Only connect external accounts and retrieve content that you are entitled to use.
8. Availability, suspension and ending use
You may stop using OctOpus, revoke connected applications and contact support to close your account. Stopping use does not itself cancel a separately agreed subscription or erase data. We may restrict access when reasonably necessary to address security threats, misuse, legal obligations or an expired entitlement. Where practicable, we will explain the restriction and provide a way to contact support.
Features may change or be interrupted for maintenance, provider outages or other operational reasons. Export important work before closing your account. Data handling after account closure is described in the Privacy Policy.
9. Responsibility and mandatory rights
To the extent permitted by applicable law and subject to any written service commitments, the service is provided as available without a guarantee of uninterrupted operation, suitability for a particular purpose or error-free output. We do not exclude liability that cannot lawfully be excluded, including applicable liability for fraud, intentional misconduct or personal injury. These terms do not waive mandatory consumer protections or statutory remedies.
You are responsible for your inputs, lawful use of the service and how you use its outputs. If a dispute arises, contact us first so we can try to resolve it. Nothing here prevents you from using a court, regulator or other remedy available under applicable law.
10. Changes and contact
We may update these terms as the service changes and will show the effective date on this page. Material changes will be communicated through the service or another appropriate channel before they take effect where required. Changes do not retroactively remove rights relating to earlier events.
